EEOC Raises Notification Penalties

Under Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act, and the Genetic Information Non-Discrimination Act, employers are required to post EEOC notices. Employers must notify their employees of relevant legislation, such as nondiscrimination laws. The EEOC even states how these notices must be posted, displayed alongside other employment notices.

This posting requirement is seemingly simple, and is often overlooked. The EEOC is looking to crack down on these slips, though, and employers who do not keep up with necessary postings will be feeling it in their wallets. Last year, Congress passed the Federal Civil Penalties Inflation Act Improvements Act of 2015. This law requires federal agencies such as the EEOC to adjust maximum civil penalties every year and sets a cap on the initial adjustment amount at 150%.

The EEOC set the new penalty for posting violations at the maximum amount. The penalty has increased from $210 to $525 per violation, effective as of July 5, 2016. This penalty increase is the perfect time to look over your office’s notices and make sure they are all up to date. If you’re missing anything, the EEO posters are available online. It can be downloaded to print, or employers who are unable to print the poster can order one sent to them.
