The EEOC has been instructed to start over on their incentive limits for wellness programs. A lawsuit brought by AARP alleged there was no basis to the agency's 30% of premium limit on incentives, and a court agreed. The EEOC needs to show reasoning behind the limit they set, rather than selecting an arbitrary percentage.
